  • in Art. 2 clause 2.1.1 of the Traffic Regulations of the Russian Federation also states that the driver must have with him and upon request present a compulsory motor liability insurance policy.

Despite the established rules, there are some contradictions regarding the need to present an insurance contract on paper. At the moment, almost every police officer has the opportunity to check a document using an electronic database; all they need is an Internet connection. Is a copy of insurance suitable for the traffic police?

It goes without saying that if compulsory motor liability insurance is issued in the office, in paper form, then making a copy of it and carrying it with you is illogical. This is equivalent to the fact that the driver carries with him a copy of his driver’s license, vehicle registration certificate, etc. Only originals must be submitted for verification. The fact is that after concluding an agreement with the policyholder and after paying for his services, the insurer sends his client a policy in PDF format. The car owner has 10 calendar days to appeal the decision (in accordance with Article 30.3 of the Code of Administrative Offenses of the Russian Federation). The period is counted from the day of delivery of the relevant notice.

It is necessary to appeal the illegal actions of the inspector through the court. The justification must include the fact that the traffic police officer neglected his duty to check the availability of insurance through the database. Back in 2015, the Government made a proposal to cancel the OSAGO policy in the printout, but until now the corresponding clause in the traffic rules has remained the same.

In the meantime, not every State Traffic Inspectorate employee will check the availability of a policy through the RSA database, since it is easier to issue a fine for lack of insurance than to waste time checking the availability of a document.
